If you have been charged with a DUI in the Seattle, Washington area, you should know that you are actually facing two separate prosecutions:

1. The Washington State department of licensing.

If you either provided a breath (or blood) sample that showed a BAC (blood alcohol content) of above .08 or if you refused to submit to a test, the Washington State Department of Licensing will attempt to suspend your license. The suspension period could be anywhere between 90 days and 365 daystwo years, depending on whether you have had DUI’s in the past.

• If this is your first offense, your suspension will be 90 days if your blood alcohol test showed a BAC of higher than the .08 legal limit. If you refused to submit to a test, your suspension will last 365 days.

• With prior DUI offense within the past seven years, your license could be revoked for two years.

• With two or more prior offenses within the past seven years, your license could be revoked for three years.

2. The Washington State criminal court system.
